Terms of Service

Welcome to Fantasy Rowing. These Terms of Service ("Terms") govern your use of the Fantasy Rowing mobile application ("App") operated by TapDown Ltd ("we", "us", "our"), a company registered in the United Kingdom.

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you confirm that you have the consent of a parent or legal guardian. We reserve the right to request proof of age or parental consent at any time.

2. Description of Service

Fantasy Rowing is a free-to-play prediction game for rowing regattas and events. Users can make predictions on race outcomes, join leagues, follow other users, and track leaderboards. The App is not a gambling service. No real money is wagered, and no financial prizes are awarded. Predictions are made for entertainment purposes only.

3. Account Registration

To use certain features of the App, you must create an account by providing a valid email address and a display name. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Ensuring your account information is accurate and up to date

You may request deletion of your account at any time through the App's account settings. Account deletion is permanent and cannot be reversed.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Impersonate any person or entity
  • Create multiple accounts to gain an unfair advantage
  • Attempt to interfere with or disrupt the App or its servers
  • Harass, abuse, or harm other users
  • Use automated systems, bots, or scripts to interact with the App
  • Reverse-engineer, decompile, or disassemble the App

We reserve the right to suspend or terminate your account if you breach these Terms.

5. Predictions and Gameplay

Fantasy Rowing is a prediction game for entertainment. Leaderboard positions and scores have no monetary value. We reserve the right to modify game rules, scoring systems, and available features at any time. Results are determined by real-world race outcomes and we are not responsible for errors, delays, or inaccuracies in race data from third-party sources.

6. Premium Features and Subscriptions

The App offers optional premium features that enhance the experience. Premium features do not provide a competitive advantage in the prediction game. They are available through in-app purchases, including:

  • Regatta Pass: A one-time purchase providing premium features for a single regatta event.
  • Season Pass: An auto-renewable subscription providing premium features for all events during the subscription period.

Subscription Terms

  • The Season Pass is an auto-renewable subscription billed on a 12-month cycle.
  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage and cancel your subscription in your device's Settings > Apple ID > Subscriptions.
  • The current subscription price is displayed in the App at the point of purchase. Prices may vary by region and are set in your local currency by the App Store.
  • Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription.

All purchases are processed by Apple through the App Store. We do not collect or store your payment information. Refund requests must be directed to Apple in accordance with their refund policy.

7. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, icons, and software, is the property of TapDown Ltd or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content in the App without our prior written consent.

8. User Content

By submitting content to the App (such as a display name or profile photo), you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content within the App for the purpose of providing the service. You retain ownership of any content you submit. You are solely responsible for ensuring that your content does not infringe the rights of any third party.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the App, you consent to the practices described in the Privacy Policy.

10. Disclaimers

The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be available at all times, uninterrupted, or error-free. We may suspend or discontinue the App or any feature at any time without notice.

11. Limitation of Liability

To the fullest extent permitted by applicable law, TapDown Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or by other reasonable means. Your continued use of the App after any changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
